Former La Vista, Nebraska-based Securities America broker and investment adviser David Zuber (CRD# 3239595) was recently named in a disciplinary action by the Financial Industry Regulatory Authority. He was barred over allegations he refused to appear for testimony in an investigation into allegations, among others, that he made private securities transactions.
According to a Letter of Acceptance, Waiver and Consent (No. 2019064979301) dated April 2021, David Zuber was associated with Securities America from February 2011 until May 2020, when he was terminated in connection to allegations he was involved “in the offer of private securities investments not approved by the firm.” In February 2021, according to the AWC Letter, FINRA sent him a “notice to appear for an on-the-record interview” as part of its investigation into whether he participated in undisclosed outside business activities and private securities transactions. FINRA notes that it is empowered under FINRA Rule 8210 to require persons under its jurisdiction to provide information in connection to its investigations, and that no such person shall fail to provide information. The letter goes on to state that David Zuber acknowledged via counsel on February 4, 2021 that he had received the request but stated he would not appear for testimony “at any time.” FINRA found that this refusal constituted violations of FINRA Rules 8210 and 2010. It consequently barred him from associating with any FINRA member in all capacities.
According to the Financial Industry Regulatory Authority (FINRA), David Zuber holds 17 years of securities industry experience and is currently barred from acting as a broker or otherwise associating with any broker-dealer firm. His prior registrations include Securities America in La Vista, Nebraska; QA3 Financial Corporation in Independence, Ohio; and WRP Investments in Cleveland, Ohio. He has passed three securities industry qualifying examinations: the Uniform Securities Agent State Law Examination, or Series 63; the Securities Industry Essentials Examination, or SIE; and the Investment Company Products/Variable Contracts Representative Examination, or Series 6.
