Former Melville, New York financial advisor Brian Court (CRD# 2591547) has been sanctioned and suspended in connection with alleged rule violations. Financial Industry Regulatory Authority records show that he was previously registered as a broker with Aegis Capital and that he has received several investor complaints.
A Letter of Acceptance, Waiver, and Consent (No. 2020068386501) describes FINRA’s disciplinary action against Mr. Court. Filed in May 2025, it alleges that as a representative of Aegis Capital, he exercised discretion during 604 transactions in 10 customer accounts without prior written authorization. “Although the customers understood that [Mr.] Court was placing trades in their accounts,” the Letter states, “none had given him prior written authorization to exercise discretion in their accounts and Aegis did not accept any of the customers’ accounts as discretionary accounts.”
As the Letter notes, FINRA Rule 3260(b) stipulates that brokers may not exercise discretion in customer accounts without prior written authorization from the customer and the firm’s written acceptance of the account as discretionary. Violations of this rule are also considered violations of FINRA Rule 2010, which stipulates that brokers must observe high standards of commercial honor. Finding that he violated these rules, FINRA issued Mr. Court a one-month suspension from associating with any member firm in any capacity.
Mr. Court’s BrokerCheck report discloses five investor complaints. The most recent, filed in 2023, alleged that as a representative of Aegis Capital, he made unauthorized trades, misrepresented and omitted material facts, failed to conduct adequate due diligence, and breached his fiduciary duty in connection with an alternative investment. In 2024 the complaint reached a settlement of $40,000.
A second investor complaint, also filed in 2023, alleged that as an Aegis Capital representative, he recommended an unsuitable real estate investment, misrepresented and omitted material facts, and over-concentrated investments in the account. In 2024 the complaint reached a settlement of $150,000.
According to the Financial Industry Regulatory Authority, Brian Court holds 28 years of securities industry experience. Most recently based in Melville, New York, he was registered as a broker with Aegis Capital from 2014 until January 2024. His past registrations include JP Turner & Company, Gunnallen Financial, Investec Ernst & Company, and Royce Investment Group. His credentials include the passage of four securities industry qualifying exams: the Securities Industry Essentials Examination, or SIE; the General Securities Principal Examination, or Series 24; the General Securities Representative Examination, or Series 7; and the Uniform Securities Agent State Law Examination, or Series 63.
