Daniel Kistler: Dempsey Advisor Faces $100K Complaint

Rome, Georgia financial advisor Daniel Kistler (CRD# 6203300) recently received an investor complaint alleging that his advice resulted in six-figure damages. Financial Industry Regulatory Authority records show that he is registered as a broker and an investment advisor with Dempsey Lord Smith.

Mr. Kistler’s BrokerCheck report discloses two investor complaints. The most recent, filed in October 2023, alleges that as a representative of Dempsey Lord Smith, he failed to conduct reasonable due diligence and unsuitably recommended a high-risk direct investment. The pending complaint alleges damages of $100,001.

An earlier investor complaint, filed in 2020, alleged that as a representative of Dempsey Lord Smith, he breached his fiduciary duty, acted negligently, and sold products for accredited investors to clients who were not accredit. In 2021 the complaint reached a settlement of $85,000.

Dempsey Lord Smith’s website includes a page describing the firm’s “disciplined” approach to wealth management. “Working within our RIA, our advisor-driven platform allows investment advisors to trade stocks, ETFs and mutual funds in the accounts,” it explains. “It can also include bonds and alternative investments bought through the RIA.  This wide variety of investment choices allows your advisor to tailor your investment portfolio to your specific needs.”

According to the Financial Industry Regulatory Authority, Daniel Kistler holds nine years of securities industry experience. Based in Rome and Alpharetta, Georgia, he has been registered as a broker and an investment advisor with Dempsey Lord Smith since 2016 and 2017, respectively. His past registrations include Retirement Cash Flow Group (Alpharetta, Georgia; 2019-2020), Roger’s Retirement Readiness Alliance (Alpharetta, Georgia 2016-2018), Coastal Equities (Wilmington, Delaware; 2016), and Waddell & Reed (Lincoln, Nebraska; 2014-2016). His credentials include the passage of four securities industry qualifying exams: the General Securities Principal Examination, or Series 24; the General Securities Representative Examination, or Series 7; the Securities Industry Essentials Examination, or SIE; and the Uniform Combined State Law Examination, or Series 66. He is licensed in Arkansas, California, Colorado, Connecticut, Florida, Georgia, Illinois, Maryland, Minnesota, Missouri, Nebraska, New York, North Carolina, Ohio, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, and Virginia.
